These Terms of Service ("Terms") govern your access to and use of DriftLens, available at https://driftlens.app.

By creating an account or using DriftLens, you agree to these Terms.

1. About DriftLens

DriftLens is a driving telemetry analysis platform designed to help users review, visualize, and evaluate their driving performance in supported racing simulations.

The platform may provide features including session recording uploads, three-dimensional driving replays, drift scoring, performance statistics, and comparative analysis.

DriftLens is an independent project and is not officially affiliated with any racing simulation developer, motorsport organization, or competition unless expressly stated otherwise.

2. Accounts and Eligibility

To access certain features, you may need to create an account.

You agree to:

• Provide accurate account information
• Maintain the security of your login credentials
• Accept responsibility for activity performed through your account
• Notify us if you suspect unauthorized account access

You must be at least 13 years old and meet any higher minimum age required by applicable law to use DriftLens.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Uploaded Content and Ownership

You retain ownership of the telemetry recordings and other content you upload to DriftLens.

By uploading content, you grant DriftLens a nonexclusive, royalty-free license to store, process, analyze, and display that content as necessary to operate and provide the services you request.

This license includes making content available to others when you explicitly use any sharing or public-content features provided by the platform.

You represent that you have the necessary rights or permissions to upload and use your content.

You are responsible for the content you upload.

4. Acceptable Use

You agree not to:

• Upload malicious, unlawful, or intentionally harmful content
• Attempt to gain unauthorized access to other users' accounts or data
• Exploit vulnerabilities or interfere with the operation of DriftLens
• Use automated tools to abuse the platform or overwhelm its infrastructure
• Circumvent storage limits, security measures, or access restrictions
• Use DriftLens in any manner that violates applicable laws or the rights of others

We reserve the right to remove content, restrict access, or suspend accounts when reasonably necessary to protect the service or its users.

5. Scoring and Analysis

DriftLens provides automated scoring and driving analysis based on recorded telemetry and its implemented algorithms.

Scores, statistics, and visualizations are provided for informational and recreational purposes.

Results may not perfectly represent real-world vehicle dynamics, official competition scoring, or actual driving performance.

DriftLens does not guarantee the accuracy, completeness, or suitability of any scoring or analysis results.

6. Beta Software

DriftLens may be made available as an early-access or beta service.

During beta development:

• Features may change or be removed
• Bugs and unexpected behavior may occur
• Performance and availability may vary
• Recorded sessions or account data may be lost
• Access to the service may be limited or interrupted

We encourage users to maintain their own copies of important telemetry recordings.

Participation in the beta does not guarantee continued access to any particular feature or future version of DriftLens.

7. Service Availability and Changes

We may modify, suspend, restrict, or discontinue features or services for maintenance, security, technical, or operational reasons.

We do not guarantee uninterrupted or error-free availability.

We may establish reasonable limits on storage, uploads, or other resource-intensive functionality.

Where practicable, we will provide notice before significant changes that affect users' stored content or access.

8. Intellectual Property

The DriftLens name, branding, website design, software, and original platform features are owned by or licensed to the operator of DriftLens.

These Terms do not transfer ownership of DriftLens intellectual property to users.

Third-party game assets, trademarks, vehicle names, tracks, and other protected materials remain the property of their respective owners.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, DriftLens is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

We do not guarantee that the service will always be available, secure, error-free, or suitable for any particular purpose.

Nothing in these Terms excludes warranties or legal rights that cannot lawfully be excluded.

10. Limitation of Liability

To the maximum extent permitted by applicable law, DriftLens and its operator will not be liable for indirect, incidental, special, or consequential damages, including lost data, lost profits, or service interruptions arising from use of the platform.

To the extent permitted by law, our aggregate liability relating to the service will not exceed the greater of $100 USD or the amount you paid to DriftLens during the preceding 12 months.

This limitation does not apply where prohibited by law.

11. Account Termination

You may stop using DriftLens at any time and request deletion of your account.

We may suspend or terminate access when users violate these Terms or when reasonably necessary to protect the service.

Account termination may result in deletion of associated recordings and account information, subject to our Privacy Policy and applicable legal requirements.

12. Changes to These Terms

We may revise these Terms as DriftLens evolves.

Updated Terms will be posted on this page with a revised effective date.

For material changes, we will provide appropriate notice and obtain renewed acceptance where required by applicable law.

Continued use after revised Terms become effective constitutes acceptance where permitted by law.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise.
